In a recent case, the question of professional licensing and employment law collided in a contentious battle. Here's the breakdown:A teacher was facing allegations of misconduct, putting their teaching license at risk. Despite receiving a one-year suspension instead of termination from an arbitrator, the school district still pursued revoking their license, citing the same issues. Our legal team intervened, arguing that the district had no authority to pursue revocation after the arbitration. We claimed it amounted to "industrial double jeopardy" and violated the teacher's civil and constitutional rights. However, the court disagreed with our position, stating that state regulators retained the autonomy to pursue license revocation independently of the arbitration outcome. This case highlights the complex interaction between employment law and professional licensing, emphasizing the need for clear and consistent guidelines in resolving such matters.Read full case summary here: https://lnkd.in/esmcbmiH.#LegalUpdate #EducationLaw #JusticeMatters #LawFirm #LegalTeam

Law students,BigLaw receives extensive coverage on campus and in the legal media. I understand. Money attracts attention.BigLaw has a very small overall impact on the law—really small compared to the Big player in the law, the government. The government hires more lawyers than any other group. Local, County, State, and Federal governments all hire lawyers. The government tends to train its lawyers. Shocking! But in my experience, government training destroys the training private law firms offer. The government will let you practice law. You'll get your own cases. The government has a vast variety of law to practice. Enormous opportunities await you in government law offices.Like to write? Join a government office handling appeals. Join a state AG's office or a PD office where you work in the appellate section, and in two years, you will have handled and argued a considerable number of cases.Want to try cases? DA's, PD, FPD, and US Atty offices are full of cases to try. First chair experience awaits.Would you like to be in court? DA's and PD's offices run the courthouse. Our cases take priority. Heck, there may even be a courthouse for our cases, as in many places, they create a Criminal Courthouse.Willing to learn, work hard, and be a team player? In five years of government work, you will learn exponentially and be much more experienced than your years in practice. As a TN ADA, for example, in 5 years, you will have handled (based on the DA Conf stats) over 10,000 criminal cases.Want access to judges and clerk staff? Work for the government.Want to have huge value to a potential employer in five years? An employer who does fun work pays well, but who doesn't advertise their positions? Work for the government and show them how to hit the ground on day one. This post isn't about bashing BigLaw. It's about opportunity. Find your opportunity.#lawstudents

Are fully online law schools the future of legal education? The ABA's recent proposal for the accreditation of fully online law schools has received overwhelming support. This move could revolutionize access to legal education, offering aspiring lawyers unprecedented flexibility and opportunity. However, some express concern that they find it difficult to learn from online law classes and the “value and prestige” of earning a law degree online would be diminished significantly.https://lnkd.in/geYCKART#lawschool #lawstudents #lawdegree #lawyer
